General Terms and Conditions of SH INTERNACIONAL, SLU, distributor of Tuboconex.fr, for sale and delivery
1. Scope
Any general terms and conditions of purchase of the customer that conflict with our own terms and conditions shall be deemed invalid, even if they are attached to the order and we have not expressly objected to their content. Acceptance of a service on our part shall in no case constitute tacit acceptance of deviating terms and conditions. In case of doubt, acceptance of our products shall be deemed acceptance of our General Terms and Conditions at the latest. This shall also apply if the customer provides for the exclusion of other terms and conditions in their own terms and conditions.
These General Terms and Conditions shall also apply to all subsequent transactions.
Amendments or additions to the contract and these terms and conditions are only valid if they have been confirmed by us in writing. By placing an order via the online shop or by email to Tuboconex.fr (SH INTERNACIONAL, SLU), you accept these terms and conditions.

3. Terms and Conditions of Sale / Validity
These terms and conditions of sale are effective immediately and supersede all our previous provisions. We reserve the right to adjust prices in response to market fluctuations.
4. Orders
- a) Orders are considered binding on the customer and are only legally binding on us once we have sent an order confirmation or invoice.
- b) Cases of force majeure (strikes, natural disasters, pandemics, customs formalities, transport blockades, etc.) shall release us from our contractual obligations.
5. Prices
All prices quoted are in euros (€), excluding VAT and shipping costs. The statutory VAT of 20 % will only be added to the cart upon completion of the purchase. Prices are for end customers.
Our offers are valid for 7 days from the date of issue. Subject to prior sale and price changes. Any exceptional increase in raw material costs will be passed on. We offer special terms for businesses and resellers. Individual quotations will be provided for high-volume orders.
6. Deliveries
The delivery area covers France (mainland). Deliveries to Corsica are subject to an island surcharge:
- Corsica: 20000–20999
You will normally receive your items within 6 to 8 working days of receipt of payment. If we are unable to deliver within this timeframe, we will inform you accordingly. Delivery times are not binding. We accept no liability for damages or loss of profit resulting from delivery delays.
The customer may only terminate the contract due to a delay in delivery if they have fulfilled all their contractual obligations on time and a grace period of at least three months set by them has elapsed without result. Even in this case, the customer shall have no claim for damages. We reserve the right to make partial or advance deliveries.
Please note: Transport damage
Damage caused in transit must be reported within 3 working days of receipt of the goods.
7. Shipping charges
For mainland France, shipping rates vary depending on size and weight. Deliveries to Corsica: island surcharge 20000–20999.
8. Availability
Sales are subject to the availability of items. You will be informed immediately if an item is unavailable.
9. Jurisdiction and Applicable Law
Andorran law shall apply. The competent court for all disputes is located in Andorra.

11. Data Protection
All personal data collected on our website https://www.tuboconex.fr is used exclusively for the purpose of processing your order. SH INTERNACIONAL, SLU, as the website operator responsible, guarantees confidentiality and processing in accordance with applicable laws.
12. Right of withdrawal
Withdrawal period
You have a right of withdrawal of 14 calendar days from the day on which you or a third party designated by you (who is not the carrier), took physical possession of the goods, without giving any reason.
Exercising the right of withdrawal

by means of a clear statement (letter or email). Sending the notification within the time limit is sufficient to meet the deadline.
Return of goods
The goods must be returned to us without undue delay and in any event no later than 14 days after notification of the withdrawal. The deadline is deemed to have been met if the goods are returned before the expiry of the 14-day period.
Return costs
The direct costs of returning the goods shall be borne by the customer. For goods which, due to their nature, cannot be returned by standard post, these costs are estimated at a minimum of €300.
Refund
The payments you have made (excluding delivery costs) will be refunded within 14 calendar days of receipt of your notice of withdrawal. We may delay the refund until we have received the goods and checked their condition. The refund will be made using the same payment method as the original transaction, unless expressly agreed otherwise.
Exclusions from the right of withdrawal
No right of withdrawal for:
- Custom-made products or products manufactured to the customer’s specifications;
- Products that have been cut or adapted to customer specifications;
- Pipes that were not supplied in standard lengths;
- Goods that have been inseparably mixed with other goods after delivery.
13. Warranty
In the event of serious defects, we shall, at our discretion, offer a replacement or repair. Any claim for rectification of defects is excluded. Tuboconex.fr (SH INTERNACIONAL, SLU) accepts no liability for indirect damages, in particular for loss of profit. This limitation of liability also applies to our employees and agents. This limitation does not apply in cases of intent, gross negligence or personal injury.
Obvious defects must be reported in writing within 3 days of receipt. All warranty claims shall lapse in the event of improper use. Returns of made-to-measure or cut tubes will not be accepted.
14. Payment
- 1a) The purchase price is due immediately and without deduction upon receipt of the invoice, unless other terms have been agreed in writing. In the event of late payment, default interest will be charged at the statutory rate. We may suspend the fulfilment of our own obligations until full payment has been made. The place of payment is Andorra.
- Payments must be made exclusively to us; our representatives are not authorised to accept payments.
- Payments made in any other way without our consent do not release the customer from their obligations.
- In the case of payment by instalments, failure to pay an instalment shall result in the entire outstanding amount becoming due.
- Offsetting against claims the customer may have against us is excluded.
- Payments shall first be applied to interest and then to the principal.
- 1b) In the event of cancellation by the customer (provided this is accepted), we are entitled to claim compensation for the damage suffered and loss of profit or a cancellation fee of up to 25 % of the purchase price.
15. Retention of title
- 1a) The goods remain our property until the purchase price, including interest and any collection costs, has been paid in full. During this period, the customer is not entitled to pledge, transfer or assign the goods to third parties without our written consent. Any impairment (seizure, damage, removal) must be notified to us immediately by registered mail.
- 1b) In the event of cancellation of the contract by the customer (provided this is accepted), we may claim damages or a cancellation fee of up to 25 % of the total amount (including costs).
16. Dispatch and Transfer of Risk
Shipping is at the buyer’s expense and risk if the buyer is acting as a trader. In this case, the risk passes to the buyer upon handover to the carrier. For consumers, the risk only passes to them upon physical handover of the goods.
Damage caused in transit must be reported immediately, but no later than 3 days after receipt, together with the consignment note. In the event of a delay in dispatch requested by the customer, storage costs of 0,5 % of the invoice amount per month will be charged from the month following the date on which the goods are ready for dispatch. Packaging materials will not be taken back. Dispatch takes place upon receipt of payment.
17. Severability Clause
Should any individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the original provision.
